BARTH OKOYE-ANICHE FLOORS NBA IN A SUIT HE FILED AGAINST THE ASSOCIATION OVER HIS DISQUALIFICATION IN THE NBA 2020 ELECTION.

 

The 2020 NBA Election aspirant for the office of General Secretary of the Association has won a Suit filed by him against the Association for disqualifying him.


Barth Okoye Aniche as Plantiff filed the action via  Suit No. FHC/UM/CS/54/2020- BARTH OKOYE - ANICHE VS REGISTERED TRUSTEES OF NIGERIAN BAR ASSOCIATION & 4 ORS, had the then President and Secretary of the Association, Paul Usoro, SAN, and Jonathan Taidi as parties. Also among the parties were Tawo Tawo, SAN and Cordelia V. Eke (Mrs.) who were Chairman and Secretary of NBA Electoral Committee respectively.


In his Judgment, the Court presided over by Hon. Justice E. N. Anyadike made following orders: 

1. That the disqualification of the Plaintiff from contesting for NBA National General Secretary is unlawful.


2. That the disqualification notice conveyed to the Plaintiff through a letter dated 23rd, June 2020 is hereby set aside.


Recall that Barth Okoye Aniche who contested for the office of General Secretary of the NBA was disqualified on the grounds that there was a Petition against him pending before the NBA Disciplinary Committee, which Petition, he had responded to same in LPDC, and was never invited by the said Committee for hearing of the matter and therefore was not found guilty of any crime by the Committee, yet he was disqualified by ECNBA.
